To Whom It May Concern,

 

I am writing to formally dispute and demand the immediate removal and blocking of fraudulent account information from my credit report, in accordance with the Fair Credit Reporting Act (FCRA)specifically § 605B (15 U.S.C. § 1681c-2). Enclosed with this letter is my FTC Identity Theft Report (Report #182385844), which provides official confirmation of the identity theft I have suffered.

 

I. Fraudulent Account Information to be Blocked (FCRA § 605B)

The following account is not mine, was created as a result of identity theft, and must be blocked from my file within four (4) business days, as mandated by 15 U.S.C. § 1681c-2(c)(1):

I did not authorize, open, or initiate this account, nor did I consent to the sharing or reporting of my non-public personal information. Reporting this account without my consent is a violation of 15 U.S.C. § 1681b (Permissible Purposes) and infringes upon my privacy rights under 15 U.S.C. § 1681a(4).

 

II. FCRA Violations — Improper Reinsertion of Previously Deleted Account

Additionally, a previously disputed and deleted account has been illegally reinserted into my credit file without notice or certification, in direct violation of the following provisions:

  • FCRA § 611(a)(5)(B) – Requires the furnisher to certify accuracy before reinsertion; no certification was provided.
  • FCRA § 623(a)(3) – Requires furnishers to correct and update previously disputed data; no such update was made.
  • FCRA § 611(d) – Requires the credit bureau to notify me in writing within five (5) business days of reinsertion; no notice was received.

This reinsertion has caused substantial harm, including:

III. My Legal Demands

Pursuant to the FCRA and all rights therein, I demand that you:

  1. Immediately block and permanently delete the (account) account and any related fraudulent entries.
  2. Immediately remove the reinserted account from my credit report and provide written confirmation of its permanent deletion.
  3. Send me written notice of all actions taken, as required under the FCRA.
  4. Conduct a full internal investigation into your reinsertion procedures.
  5. Compensate me for the damages caused by your failure to comply with the FCRA. Failure to comply will result in immediate complaints filed with the Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), and may result in civil litigation under 15 U.S.C. §§ 1681n and 1681o, which allow for statutory, actual, and punitive damages.

 

Failure to respond satisfactorily within 15 days of receipt of this certified letter may result in a small claims action against your company, seeking $5,000 per violation for:

1.) Defamation

2.) Negligent Enablement of Identity Fraud

3.) Violations of the Fair Credit Reporting Act

4.) Financial Injury

5.) PENALTY OF PERJURY

6.) Violations of 15 U.S.C 1692g

7.) 15 U.S.C 1692a abusive practices

8.) 15 U.S. Code § 1681b - Permissible purposes of consumer reports

Please be aware that dependent upon your response, I may be detailing  any potential issues with your company via an online public press release,  including documentation of any potential small claims action.
